There will be10% buyer's premium for all items purchased, but no sales tax will be applied.  A 5% Convenience fee will be added to credit/debit card purchases.  A credit card is required to register and a $500 authorization will be run to check the validity of the card, but purchases will not be charged to your credit/debit card unless you instruct us to do so at pickup. If you don't pay your invoice by closing time on the last pick up day, your card on file will be charged for the amount owed. You may pay with cash or check to avoid the credit/debit convenience fee. Please call 870-376-8765 if you need assistance.  All items sell AS-IS, WHERE-IS. There is no warranty expressed or implied on auction items. Buyer's are responsible for reading descriptions, examining pictures and inspecting items in person to their satisfaction before bidding. All bids are a legally binding contract, and all sales are final. Buyer understands and expressly agrees any statements or representations concerning the value, condition or quality, useful life, or use of the item made by any representative of Auction-action.com to the buyer is simply opinion, not statements of fact, and do not create any promise, warranty, or guarantee for the buyer's benefit. It is the buyer's sole responsibility to physically inspect items prior to bidding.  Any loading of items is the responsibility of the buyer and Auction-action.com is not responsible for any injury or damage during loadout. Any Buyers and their agents agree to participate at their own risk.  Buyer shall be responsible for any and all taxes, shipping costs, and shipping or delivery arrangements. Buyer is responsible for abiding by loadout assistance dates/times as well as item removal deadlines. By registering to bid, buyers consent to receiving marketing messages by text and/or email from time to time. You can unsubscribe at anytime and will no longer receive these alerts. This is an online only auction.  A credit card is required to register for online bidding. Nothing will be charged to your card UNLESS you fail to pay or make payment arrangements by closing time of last pick up day.  FULL PAYMENT IS DUE BY the end of the last pick up day.  If an invoice remains unpaid after the last pick up day, Auction-Action.com reserves the right to run the card on file for up to the full amount of all invoices totaling $2,500 or less and for up to a $2,500 deposit all other invoices. We do not accept payment by mail. Items cannot be removed from premises without receipt of payment in full. Bids placed at this auction are a legally binding contract. All sales are final. Auction-Action.com reserves the right to hold any items from removal until full payment is verified. All items are to be removed within 14 days from date of sale. After 14 days, $20 per item, per day storage will be charged. After 60 days, items will be considered abandoned and sold for storage with no refund.

Amendments to auction catalog, descriptions or terms of sale day thru auction day, take precedence over all advertisements.

By registering for this auction, bidder acknowledges that they are fully responsible for any personal injury or property damage caused by bidder, bidders guests or agents. Bidder agrees to hold Auction-action auctions harmless for any personal injury to himself or his agents and any property damage incurred on auction premises. Bidder releases Auction Action and the seller from any and all liability connected with the loading, removal and transportation of purchases and all future uses for the goods purchased herewith. By registering for this and other auctions, buyers, buyer's agents and other related parties acknowledge that the provisions of this agreement ( the auction terms) are governed by the State of Arkansas, without regard to conflict of laws from any other jurisdiction(s). Further, for the purposes of any action, lawsuit or other proceedings brought to enforce this Agreement, relating to it, or arising from it, the parties hereby submit to and consent to the sole and exclusive jurisdiction of the courts of Independence County, Arkansas, or the federal courts for the Eastern District of Arkansas, the venue in which this agreement is executed, and no other courts.
